Select any Charter case that deals with the following issues:
– Indigenous land rights
– Voting Rights
– Equality Rights
For example, you may choose R. vMorris (2006), which deals the Indigenous Treaty Rights or Mugesera vCanada which dealt with immigration issues. The Supreme Court Charter Cases website (https://scc-csc.lexum.com/scc-csc/en/nav.do) provides the full list of all Charter cases since 1982. There are no limitations on how old the cases as long as they comply with one of the issues mentioned above.
You will clearly need to do a little bit of research on the cases that fall within one of the issues before searching for the case in that link.
In a 4 page report, answer the following questions as it relates to the case that you have chosen.
1. If the Supreme Court rendered a majority decision in this case, what decisions in previous cases guided them ?
2. If there was a dissenting opinion, what cases did they turn to ?
3. How did the courts play a role in the decision-making? Were there outside influences ?
4. Reflect on the importance of this case in setting a precedent for similar cases.
5. How do you think this case will shape the future of the issue in question? Is it still relevant? Should there be a different ruling?
This brief should contain an opening introductory paragraph as well as a brief concluding paragraph. You are required to use outside sources to supplement some of the information. You can use as many outside sources as you would like.
Note – Do not use first person pronouns for this assignment, this assignment should be written in an academic friendly format.
